Spurious Lawsuit Of The Week

A South Carolina inmate is suing Atlanta Falcons quarterback Michael Vick for “$63,000,000,000 billion dollar[s]” alleging that Vick stole two of his pit bulls, sold them on eBay and used the proceeds to buy missiles from Iran.

Somehow, I have a feeling that Mr. Vick’s attorneys need only file a Fed. R. Civ. P. 12(b)(6) motion for failure to state a claim to be rid of this suit — and the inmate could conceivably be sanctioned under Fed. R. Civ. P. 11.

I also have a feeling that only a law student/Civil Procedure addict would read this story and instantly try to figure out which pleading rule(s) it violates…

UPDATE: A Volokh Conspiracy commenter finds a relevant statute that allows a court to dismiss such frivolous charges. Break that one out at your next cocktail party…*
